4. Booking, Estimates & Service Agreements

Free inspections and estimates provided via the website or over the phone are based on initial information and are non-binding until confirmed in writing.

We reserve the right to decline service for any reason, including but not limited to: safety concerns, access restrictions, or improper scope fit.

5. Licensing, Permits & Code Compliance

AtticShield operates under a valid B & C-2 insulation contractor license issued by the California Contractors State License Board (CSLB). All work is performed or overseen by appropriately licensed and insured personnel.

Homeowners are responsible for complying with applicable HOA rules or local permits unless specified otherwise in writing. If permits are required, AtticShield will assist with the process where applicable, but does not assume legal responsibility for permitting unless contractually obligated.

6. Warranty Disclaimer

Workmanship warranties are limited to the terms set forth in the individual service agreement and may vary by project scope and service type.

AtticShield does not provide warranties or guarantees for:

• Manufacturer materials (covered by their respective manufacturers)

• Damage caused by misuse, external forces, animals, water, fire, or client modification

• Electrical, plumbing, or structural systems not installed by AtticShield

• Labor performed by third parties or subcontractors not engaged directly by AtticShield

No warranty is valid unless the project is paid in full under the terms of the service agreement.

7. Website Content & Intellectual Property

All content, trademarks, service marks, logos, text, images, graphics, and videos on this website are the intellectual property of AtticShield or its licensors.

You may not copy, reproduce, modify, or distribute content from this site without prior written permission.

Use of our branding, images, or customer reviews for any commercial purpose is strictly prohibited.

8. Payment Terms

Payment terms will be clearly outlined in each project’s service agreement. Generally, payments are due as follows:

• For most services: Full payment upon completion unless otherwise agreed

• For larger projects: A deposit may be required

• Late payments may incur interest at the maximum legal rate allowed under California law

We accept payment via credit card, check, ACH, or financing through approved partners (when available). Returned checks may result in a service fee.

9. Limitation of Liability

To the fullest extent permitted by California law, AtticShield, its owners, employees, agents, and affiliates shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages

• Loss of property value or resale delay

• Temporary discomfort due to insulation removal or sanitization

• Issues arising from pre-existing damage, infestations, or conditions not caused by AtticShield

AtticShield’s liability for any claim shall not exceed the total amount paid by the customer for the specific service giving rise to the claim.

10. Dispute Resolution & Governing Law

Any disputes or claims arising out of or relating to these Terms or services performed by AtticShield shall first be attempted to be resolved informally and in good faith by both parties.

If resolution cannot be reached informally, you agree to resolve the dispute through binding arbitration in San Diego County, California, under the rules of the American Arbitration Association (AAA). You agree to waive your right to a jury trial.

These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions.

11. Privacy and Data Security

Please refer to our separate Privacy Policy to understand how we collect, use, and protect personal information provided through our website or service requests.

AtticShield complies with the California Consumer Privacy Act (CCPA) and will never sell your data.

12. Right to Refuse or Cancel Service

We reserve the right to cancel, suspend, or refuse service for:

• Unsafe work conditions or inaccessible areas

• Presence of hazardous materials not disclosed during the inspection (e.g., asbestos, live electrical issues)

• Hostile, abusive, or threatening behavior by a customer

• Failure to make payment under agreed terms

• Unapproved project scope changes

If a project is canceled by the client after materials are ordered or labor has been scheduled, cancellation fees may apply.

13. Emergency or After-Hours Work

AtticShield typically operates Monday through Friday, 7 AM to 5 PM. Weekend or emergency work is available only by special request and may incur additional fees.

We are not an emergency remediation provider for fire, flood, or biohazard events. For urgent matters outside our scope, contact appropriate emergency services or licensed disaster recovery companies.

14. Health & Safety Compliance

Our technicians adhere to California OSHA regulations and follow safety protocols on every job, including:

• Use of personal protective equipment (PPE)

• Ladder and attic access safety

• Proper waste disposal

• Rodent-borne hazard protocols

• Air quality and ventilation precautions

We ask that homeowners avoid the work area during service unless necessary.

15. Third-Party Services

From time to time, AtticShield may recommend or refer third-party contractors (e.g., electricians, roofers, HVAC specialists) for services beyond our scope.

We are not responsible for the conduct, warranties, or work quality of any third-party service providers not hired directly through AtticShield.

16. Testimonials and Reviews

By submitting a testimonial, review, or feedback to AtticShield, you grant us a royalty-free license to use it on our website, marketing materials, or third-party review platforms. We will never display your full name or address without your written permission.
